  • By law, every person charged with a DUI or a DWI has to do a drug and alcohol assessment. The court will require it and the Department of Public Safety, “DPS”, will require it to get your driver’s license back. ONE ASSESSMENT will suffice for both the court and the DPS. The assessment is about an hour long and you will have to answer 100 questions about your drug and alcohol habits. After you take the assessment, the assessor will have recommendations for you. Usually, the assessor recommends a 10-hour drunk driving class, given over a weekend, if this is your first contact with law enforcement because of alcohol or drugs. If this is your second contact, the assessor often recommends at 24-hour drunk driving class that is given over a term of 6 weeks. The assessor can also recommend “inpatient” treatment or 6 weeks of intensive out-patient treatment. Whatever the assessor tells you to do are REQUIREMENTS for both the court and DPS. You must follow the recommendations of the assessor and bring proof to the court and to DPS that you finished the recommendations. However, the costs of the assessment and the recommendations are set by statute.

  • The Court and DPS will also require that you do the Victims Impact Panel, or “VIP”. You must attend this group setting and provide proof to the court and to DPS that you completed the VIP. You MAY NOT do an online course. You can Google “Victims Impact Panel Tulsa” and find one to attend in your area. The cost is about $65.00. For those of you going into Youthful Drunk Driving, the VIP will be part of your program through the courts. YDD participants will do and pay for the VIP through the YDD program.
  • Your Arraignment is where the court formally reads to you what your charges are.
  • The court date after your Arraignment, called “Status”, if a misdemeanor, or Preliminary Hearing, if a felony, is generally your attorney’s first opportunity to talk to the prosecutor about the facts of your case.
  • OSCN.NET is a website you might become familiar with. When you are arrested, you have arrest charges. The police are going to file their paperwork and videos, etc., with the DA’s offices. The DA will file criminal charges against you and you can follow your case on oscn.net once the criminal charges are filed, typically a day or two before the date of your Arraignment.
